1st degree murder charge? It is at most 2nd degree murder. He drove the SUV while she was trying to climb in and then ran in to another vehicle and she got hit and was killed. I wonder if they’re trying to scare him in to a plea bargain. 1st degree murder is done after deliberation and intent to kill. Someone getting angry in an argument and killing someone is not 1st degree.

Could be correct. Overcharging is common. Sometimes backfires. Near me a clear case of manslaughter yet state charged murder in the first. Jury found the defendant not guilty since there was no premeditation.

This would be pretty darn funny if not for the fact it’s not surprising. How stupid have people become that they choose to risk bodily harm and death for $400?

I have no sympathy for the deceased woman or her loser husband, but I find it a sad commentary on our society.

Sad commentary indeed. These folks have no consideration for what their actions may cause. In some jurisdictions If a death occurs while a crime is committed the death can carry a 1st degree murder charge even if the intent to kill was not part of the crime.

I laughed a little when I 1st read this… I have NO sympathy for a thief, much less a pair of them… The world is a better place without people like that anyway…

In at least one state you can steal up to $900 and no charge so unfortunate they picked the wrong state. At any rate the charge is silly. Who was in the seat and who tried to also get in? To me the most would be reckless endangerment or unsafe operation. But they
expect the guy will plea down and guilty to something to avoid a trial. The last county attorney we had tried something like this, cost the guy tens of thousands and ruined his life before we voted the attorney out.

That sort of thing is getting quite a bit of push-back from the citizens, even in California. DA’s being recalled by voter initiative, etc. I think there one of these going on in LA currently. A judge in this area was recalled a few years ago in this area for a similar reason.
