If it is really a bad muffler, the problem is primarily the noise pollution. It is also possible that you could get a ticket for the noisy exhaust system.
That said, it is very important that you check for leaks in the exhaust system ahead of the muffler. Leaks can cause exhaust gases to infiltrate the interior of the car.
