I ran a stopped school bus

I forget which rationale was used but was ruled unconstitutional in minnesota. So they can pass all the legislation they want but if unconstitutional, the law is invalid.

You are correct but a law, once passed is law, until it is ruled unconstitutional and some times it takes a while and someone who wants to take on the big boys…

If anyone is wondering, my court date has been postponed to either July or August due to backlog.

In the meanwhile, and if you are interested, I encourage you to read this article. It has complaints identical to mine. So I’m really not alone.

School bus update.

Hello everyone. Those of you who are familiar with my school bus violation case deserve to know the outcome.

I received a video captured by the school bus camera showing clearly that I indeed violated the school bus. My initial explanation of what had happened did not align well with what shown in the video, and as a result, I was scared to death.

I’m grateful, however, that some of you guys here urged me to lawyer up.

I’m happy to inform those who followed this thread that my lawyer successfully got the court to dismiss my case entirely. I will not be given points nor traffic school, but instead a warning to drive carefully.

Good to hear that, C33, and glad to see you back in here, and not in that steaming toilet called Fakebook!

So now, when you see traffic around you start to act a different way collectively, find out why.

I call it, SA - situational awarness.

And let’s hope New York state someday changes that over-protective law regarding stopping for stopped school buses in the next county, etc. lol!

Hoooookay, here goes:

I think I finally have an idea where Clueless33 was, relative to traffic, when he proceeded to go against a stopped school bus.

The following diagram may not be to scale, but it is based on everything I read in Clueless’ original post about this incident. I’m not sure exactly if there was a shared center turn lane or not.

In the diagram, we see, from left to right, the yellow vehicle(we all know what that is!), the blue and white tractor trailer, having just shifted into the turn lane, the blue sedan = Clueless themself, and the other truck present, the red and white semi.

The two trucks and Clueless are shown exactly where they slowed to a stop, and where Clueless would slow down, anticipating a pedestrian, but seeing nobody cross from either way, in front of the two trucks, he proceeded. Once he was clear of the red tractor trailer to his left, it would be too late for them to stop for the indicating school bus.

The transparent green area outlined in green is used to represent Clueless field of view at the moment both large trucks slowed to a halt. Clearly the bus is not in his view zone, because from where he states he was, you cannot see through an adjacent large vehicle.:

This second diagram show Clueless accelerating away from the stopped traffic to either side of him, and seeing the bus only when it is too late to stop. His “green zone” of vision, along with his position, has shifted - too late - to include the bus.:

20 to 30 sec. later, a police dispatch would pull Clueless over.

I hope this diagram clears up what happened to Clueless33, and perhap suggests that Clueless is not so “clueless” after all! He was in what I would call a “100 year” scenario: a rare confluence of vehicles that happened to perfectly block from him a view of the stopped school bus.

Should he have stopped to think about why traffic around him had suddenly stopped?

Perhaps.

Should he have slowly pulled up alongside the blue truck cab, and glanced around it to see why that truck had stopped?

Possibly.

I’m “slow” myself, for reason I described in another thread here. So the same thing might have happened to me.

Excellent, Chris. Exactly how I would explain this. I wonder if my lawyer used the same argument in court ?

Also, when I mentioned to the lawyer that I got screwed from what the school bus video showed, he said the bus’s camera had a better view to defend itself doesn’t mean it’ll be the same view on my end.

The school bus video makes it seems like I was careless. When I watched it, I was like “ wow did I really drive like that ?”

The lawyer said he would go ahead to challenge it because the video from the bus doesn’t tell the whole story.
