Rich , why in the world would the person who got hit want to use his insurance ? That makes no sense at all.
I had my entire rear bumper cover repainted over far less than what happened to the truck in the picture.
A complete bumper assembly with park assist sensors cost $1,200, the owner of the truck probably only called and asked for the price of a new bumper. If an insurance adjuster looked at the truck they would likely only pay to have the bumper repainted.
Looks like just a trim strip to me.
From that photo angle it looks like a trim strip but it is the paint section of the bumper above the step.
Update: Called the Insurance company and filed a claim. They apologized for the misinformation provided by the agent. I was surprised to find out that even after taking the cash, the other party could still file a claim. Wow, thatâs crazy.
The claim agent mentioned that in newer cars they normally replace the entire bumper. It is out of my hands now. I will definitely find a new agent. Anyways, thanks for your guidance and input. Have a nice day!

I even had my car purposely scratched (keyed) by somebody who also left a note accusing me of taking two parking spaces. It was in San Francisco. I parked in the middle of a space big enough for 1-1/2 cars. If I had pulled up against the car in front, something like a Smart Car could have parked against me in the back, but then I wouldâve been blocked in. I paced off the distances before leaving my car there and saw that I could not have left room for another car without allowing me to be blocked in.

And thatâs perfectly OK. OPâs son caused a loss. OPâs son owes compensation for that loss. It is not required that the victim apply the compensation toward fixing the bumper if he doesnât want to.
Put it in a different framework. If I come over to your house and break your beer glass, itâs incumbent upon me to make up for the loss I caused you. Since I donât know where you got the beer glass, Iâll just ask you how much it would cost you to replace it and then give you the money. What you do with that money is your affair, not mine. I donât get to complain or demand that you give me the money back if you choose to buy a shot glass instead.
And the final takeaway from this thread is that insurance agents are not always, or even often, completely knowledgeable about how insurance works. I learned that the hard way as a new driver. I listened to my idiot insurance agent who told me I should have full coverage on my 25 year old car. After an old lady ran me off the road and into a snowbank, the bumper needed to be replaced. Not the bumper cover, just the bumper.
She drove off, oblivious to what she had caused, so I had no one to go after. I went to file a claim and they told me they were going to total the car. For a $200 repair? I was paying them more than double that every 6 months for the coverage. And they were only going to give me $800 for the car.
Had my insurance agent been smart about insurance, heâd have advised me to load up on liability coverage and then have a slush fund to pay for repairs. The lesson from that is to always thoroughly investigate anything an insurance agent (who is, after all, just a salesman) tells you before acting on it.
This incident happened in a parking garage. Monday we had to use a 6 story parking garage at the hospital . We did what we always do . We drove to the top floor where there were few vehicles and backed in a spot. When we came back we did not have any vehicles next to us and we just drove out without problems. Maybe the OPâs son can change his parking habits and not have this happen again.
Years ago a kid hit the back of my car so bad. He begged me that he could fix my car without insurance involved. I simply told him âI dont get hurt. Dont worry, just got a trunk and tail light anywhere or junk yard, same color, and install them at my homeâ.

If he owns it, I agree. If there is a lien holder, they may require it to be repaired with the settlement money to protect their interest in the vehicle. Assuming everything is above board and insurance is involved. As you pointed out, the person that did the damage has no say in it regardless.
